This page (together with the documents we refer to on it) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) on our website (our site) to you. These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them before ordering any Products from our site.

By ordering any of our Products, you acknowledge being 18 years old or older and you agree to be bound by these Terms and the other documents referred to in these Terms. Please print a copy of these Terms for future reference.

We amend these Terms from time to time as set out in clause 6. Every time you order Products from this site, please check these Terms to ensure you understand the terms which will apply at that time.

1. INFORMATION ABOUT US

We are LVMH SWISS MANUFACTURES SA, TAG HEUER BRANCH, a company registered in the Neuchâtel, Switzerland, Register of Commerce and Companies under the number CHE-105.935.430, with headquarters at 6A, rue Louis-Joseph Chevrolet, 2300 La Chaux-de-Fonds, Switzerland, (“we” or “us”). We operate the website www.tagheuer.com.

2. THE PRODUCTS

2.1. The description of the Products on our site is approximate only and images of Products are for illustrative purposes only. Whilst we make every effort to be as accurate as possible on our site in the description of the Products (including, without limitation, the size, weight, capacities and dimensions of the Products) and to display colors accurately, any description is approximate only and we cannot guarantee that the colors displayed on our site accurately reflect the color of the Products.

2.2. The packaging of the Products may also vary from that shown in the images on our site.

2.3. All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available. If the Product you ordered is not available, we will not process your order.

3. HOW WE USE YOUR PERSONAL INFORMATION

We use the personal information you provide to us in accordance with and for the purposes set out in our Privacy Policy which is accessible here. Please take the time to read it, as it includes important terms which apply to you.

4. YOUR RIGHTS AS A CONSUMER

4.1. As a consumer, you have legal rights in relation to Products we sell to you on our site that are faulty or not as described. Nothing in these Terms will affect your legal rights. In addition to these legal rights, please note that the Product you purchased may be covered by a commercial warranty under the conditions set out in the warranty document included in the original packaging of the Product.

4.2. Specific terms and conditions may apply according to your jurisdiction. Please refer to the clause “SPECIFIC ADDITIONAL TERMS & CONDITIONS PER LOCAL JURISDICTION”.

5. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

5.1. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order before submitting it. If you submit an order to us which contains an error, please contact us by email or by phone as soon as possible to correct the error. We will try to correct any error in the order submitted by you before it is processed, but we cannot guarantee this.

5.2. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. This order acknowledgement does not mean that your order has been accepted by us. We will confirm our acceptance of your order by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.

5.3. If we are unable to supply you with a Product (for example because that Product is not in stock, no longer available or because of an error in the price on our site as set out in clause 9.4 below), we will inform you of this by e-mail and we will not process your order. If you have already paid for the Product, we will refund you the full amount as soon as possible and in any event, within 14 days of our e-mail notification to you.

6. OUR RIGHT TO VARY THESE TERMS

6.1. We may revise these Terms from time to time. You should read these Terms carefully prior to the purchase of each Product from our site.

6.2. Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.

6.3. If we revise these Terms and you have already placed an order with us, the revised Terms will not apply to the order that you have placed.

7. RETURN

For France, Germany, Italy, and Spain, please refer to the clause “SPECIFIC ADDITIONAL TERMS & CONDITIONS PER LOCAL JURISDICTION” set out below. For any other jurisdictions, the following shall apply:

7.1. We want you to be completely happy with your order. Subject to certain exceptions detailed below, if for any reason you are not satisfied, we will gladly accept your return within 30 days of receipt of the original item, at our expense.

7.2. To return an item, please follow our return process included in your parcel or through this link.

7.3. Please note: a return authorization must be initiated within 30 days of receiving the Product and the Product returned within 10 days of the return authorization being issued. In addition, all Products must be returned with the original receipt, in an unused state and in brand-new condition, with all original shipping and Product packaging, protective materials, and tags in place.

7.4. We will not accept any return if the Product shows signs of wear or has been used or altered from its original condition in any way, or if the 10 day returns authorization has passed.

7.5. Personalized Products are considered as final sale and cannot be returned for exchange or refund.

7.6. Watch bracelets that have been adjusted at your request must have been done so by us or a TAG Heuer Authorized Retailer and should be returned with all the links originally shipped.

8. DELIVERY

8.1. We do not charge our clients for shipping and handling. We normally send all merchandise using a reliable carrier. Depending on the country of delivery, please allow 3 to 14 calendar days for delivery once you have received the Dispatch Confirmation.

8.2. Please refer to your delivery confirmation email from our carrier for exact details and parcel tracking reference.

8.3. For orders totaling over 50’000 Swiss Francs or Euros, a TAG Heuer Customer Service Representative will contact you to arrange delivery.

8.4. Please note that you might experience a delay on the delivery due to customs requirements on your home country.

8.5. Please note that the Products might be subject to local customs charges.

9. PRICE OF THE PRODUCTS AND DELIVERY CHARGES

9.1. The prices of the Products will be as quoted on our site from time to time. Please see clause 9.4 for information about price errors on our site.

9.2. Prices for our Products may change from time to time. Any changes to the price of Products on our site will not affect any order for Product(s) which we have confirmed to you with a Dispatch Confirmation.

9.3. The price of a Product includes VAT (where applicable) at the applicable current rate chargeable in your jurisdiction for the time being.

9.4. Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price. In such case, we will contact you to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

10. PAYMENT

10.1. Unless otherwise indicated, all prices on our site are in Swiss Francs or Euros.

10.2. You can pay for Products using a debit card or credit card. We also accept bank wire transfer. In the process of wire transfer, the order will not be processed until the payment has been received and confirmed by us by e-mail. After placing your order, payment should be credited into our bank account within seven days. If your payment has not reached our bank account within seven days, your order may be cancelled.

You agree to pay in full the prices for any purchases. Payment for the Products is in advance.

10.3. Certain Products that you purchase on our site may be subject to additional Terms presented to you at the time of such purchase.

11. OUR LIABILITY TO YOU AS A CONSUMER

11.1. If we fail to comply with these Terms, we will be responsible to you for the loss or damage you suffer that is a foreseeable result of our breach of these Terms.

11.2. We only supply the Products for domestic and private use.

12. EVENTS OUTSIDE OUR CONTROL

12.1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an act or event beyond our reasonable control (“Event Outside Our Control”).

12.2. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

 (a) we will contact you as soon as reasonably possible to notify you; and

 (b) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

13. HOW TO CONTACT US AND COMMUNICATIONS BETWEEN US

13.1. When we refer in these Terms to "in writing", this will include e-mail.

13.2. You can contact us for any reason using the following means:

13.3. If we need to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.

14. OTHER IMPORTANT TERMS

14.1. We may transfer our rights and obligations under a Contract to another organization, but this will not affect your rights or our obligations under these Terms.

14.2. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

14.3. This Contract is between you and us. Except as expressly set out in this clause 14.3, no person who is not a party to this Contract shall have any rights to enforce any of its terms. The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under this Contract are not subject to the consent of any other person.

14.4. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

14.5. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and any written waiver does not mean that we will automatically waive any later default by you.

14.6. Subject to any mandatory provisions of your local jurisdiction and the clause “SPECIFIC ADDITIONAL TERMS & CONDITIONS PER LOCAL JURISDICTION” set out below, these Terms are governed by Swiss law, so that the Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with the Contract (including non-contractual disputes or claims) will be governed by Swiss law and you and we both agree that the courts of Switzerland will have exclusive jurisdiction. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of your local jurisdiction.

15. OTHER IMPORTANT TERMS

15.1. Il programma Trade-In Connected (il "Programma") operato da TAG Heuer, parte di LVMH Swiss Manufactures SA, con sede legale presso 6A rue Louis-Joseph Chevrolet, 2300 La Chaux-de-Fonds, Svizzera ed in Italia dalla sua distributrice esclusiva LVMH WATCH & JEWELRY ITALY spa, corrente in Milano Via Albricci 8 ( di seguito anche più semplicemente “TAG HEUER“ o “Noi”) programma in vigore a partire dal 10 febbraio 2022 (la "data di entrata in vigore") offre al Cliente la possibilità di ricevere un credito in cambio dell'orologio TAG Heuer Connected di precedenti generazioni attualmente posseduto dal Cliente stesso ("l'orologio"/"l'orologio del cliente"), per l'acquisto dell'orologio TAG Heuer Connected di ultima generazione lanciato sul mercato da TAG Heuer nel 2022 (il "nuovo TAG Heuer Connected"). Il programma è regolato dai termini e dalle condizioni sottostanti (i "Termini del Trade-In"). Prendendo parte al Programma, il Cliente accetta tali Termini del Trade-In.

15.2. Il programma potrebbe non essere disponibile in tutti i negozi TAG Heuer. Consultare la nostra pagina web https://www.tagheuer.com/stores per trovare la lista di negozi TAG Heuer selezionati in cui è disponibile il Programma (i “Negozi TAG Heuer selezionati”). È anche possibile approfittare del Programma dopo aver acquistato un nuovo TAG Heuer Connected sul nostro sito web seguendo la procedura descritta nel paragrafo 7.

15.3. L'orologio del Cliente potrà partecipare al Programma se fa parte di una delle generazioni di orologi TAG Heuer Connected previste come idonee (per ulteriori informazioni sulle generazioni idonee, visitare la pagina web del Programma https://www.tagheuer.com/smartwatches/connected-trade-in.html o chiedere agli addetti alle vendite presso uno dei negozi TAG Heuer selezionati), se è possibile confermarne l'autenticità e se il numero seriale è perfettamente leggibile. TAG Heuer si riserva il diritto di non accettare specifici orologi in base alla loro condizione (soprattutto se la loro autenticità non può essere confermata).

15.4. Il Cliente potrà portare il proprio orologio in negozio e ricevere un credito (il "Credito Trade-In") per l'acquisto di un nuovo TAG Heuer Connected, realizzato a partire dalla data di entrata in vigore del Programma. Il totale del Credito Trade-In può variare, in quanto stabilito e modificato esclusivamente da TAG Heuer di volta in volta , in base alla generazione dell'orologio che si desidera rendere. Consultare la pagina web del Programma o rivolgersi agli assistenti di vendita dei nostri negozi TAG Heuer selezionati per ottenere informazioni aggiornate sui valori del Credito Trade-In. L'approvazione e la messa in pratica del Programma per il reso dell'orologio del Cliente e per ricevere il Credito Trade-In comporta il trasferimento del titolo e della proprietà dell'orologio già posseduto dal cliente a TAG Heuer, inoltre detto orologio non verrà restituito in alcun caso al Cliente dopo il trasferimento del titolo e della proprietà a noi, secondo i termini del Programma (vedere anche il paragrafo 6 e il paragrafo 7).

15.5. Le informazioni personali di cui potremmo avere bisogno e che potremmo richiedere sulla partecipazione del Cliente al Programma verranno elaborate secondo la nostra informativa sulla privacy, consultabile sul sito https://www.tagheuer.com/privacy-policy.html.

15.6. Negozi TAG Heuer selezionati: Per approfittare del Programma in uno dei nostri negozi TAG Heuer selezionati, è necessario acquistare un nuovo TAG Heuer Connected in negozio contemporaneamente con il trade-in dell'orologio già posseduto dal Cliente. È necessario quindi portare in negozio l'orologio che si vuole rendere, in modo tale che i nostri team possano confermare l'idoneità e il valore dello stesso ai fini del Credito Trade-In. Dopo aver completato con successo questi passaggi, se desidera procedere, il cliente riceverà il Credito Trade-In per l'acquisto simultaneo di un nuovo TAG Heuer Connected. Il titolo e la proprietà del vecchio orologio del Cliente verranno trasferiti a TAG Heuer dopo il completamento dell'acquisto del nuovo TAG Heuer Connected con il Credito Trade-In. Partecipando al Programma e consegnandoci il vecchio orologio, il Cliente dichiara e garantisce di essere l'unico proprietario legale di tale orologio e di risarcire TAG Heuer per qualsiasi reclamo causato da un reso non autorizzato dell'orologio in questione, nel caso in cui il cliente non fosse il proprietario legale dell'orologio o qualora non avesse il diritto di trasferirne la proprietà a TAG Heuer, ad esempio per diritti di terze parti.

15.7. Sito web e-commerce TAG Heuer: Per approfittare del Programma dopo aver effettuato l'acquisto online di un nuovo TAG Heuer Connected sul nostro sito web e-commerce, è necessario prima di tutto completare l'acquisto del nuovo TAG Heuer Connected. Contattare il nostro Servizio clienti entro trenta giorni (30) dalla consegna del nuovo TAG Heuer Connected per avviare il processo trade-in. Il nostro Servizio clienti fornirà (i) le istruzioni per mettere in pratica una valutazione iniziale dell'idoneità dell'orologio del cliente e del Credito Trade-In applicabile (è inoltre possibile contattare il nostro Servizio clienti per effettuare questa valutazione iniziale prima di acquistare il nuovo TAG Heuer Connected), (ii) le istruzioni e le tempistiche richieste per la consegna dell'orologio del cliente presso TAG Heuer qualora la valutazione di idoneità iniziale sia positiva e (iii) un'etichetta di spedizione prepagata che dovrà essere utilizzata per restituire il vecchio orologio del Cliente. Se l'orologio viene inviato senza fare uso dell'etichetta di spedizione prepagata, il costo della consegna sarà a carico del Cliente. Se non si contatta il nostro Servizio clienti entro il periodo di trenta giorni (30) o se il vecchio orologio del cliente non viene inviato entro il periodo di tempo indicato dal nostro Servizio clienti, non si potrà approfittare del Programma e l'orologio non sarà più idoneo per beneficiare del Credito Trade-In.

Dopo la ricezione dell'orologio del cliente, spedito conformemente alle nostre istruzioni, il nostro Servizio clienti procederà alla conferma finale dell'idoneità e del Credito Trade-In applicabile e comunicherà tale conferma al Cliente. In seguito alla conferma e allo scadere del periodo di reso applicabile all'acquisto del nuovo TAG Heuer Connected (vedere paragrafo 13), il titolo e la proprietà dell'orologio verranno trasferiti a noi e verrà applicato il paragrafo 8. Provvederemo al pagamento dell’ importo corrispondente al Credito Trade-In dopo la fine del periodo di reso applicabile al nuovo TAG Heuer Connected, nella stessa valuta e attraverso lo stesso metodo di pagamento usato per l'acquisto del nuovo TAG Heuer Connected. Se decidiamo che l'orologio del Cliente non è idoneo a partecipare al Programma, ai sensi delle Condizioni del Trade-In, il nostro Servizio clienti informerà il Cliente di conseguenza e restituiremo l'orologio al cliente a nostre spese.

15.8. Prendendo parte al Programma, il Cliente comprende e accetta che una volta che il titolo e la proprietà del vecchio orologio siano trasferiti a TAG Heuer, TAG Heuer inizierà il processo di smaltimento dell'orologio del Cliente, che non potrà più essere recuperato. Il Cliente rinuncia quindi a qualsiasi diritto sull'orologio non appena quest'ultimo sia stato reso a TAG Heuer, compreso il diritto di usufruire, se del caso , del suo valore se non attraverso il Credito Trade-In ricevuto.

15.9. È necessario effettuare il ripristino delle impostazioni di fabbrica e rimuovere tutte le informazioni personali dall'orologio prima di renderlo o di inviarlo a TAG Heuer ai sensi dei paragrafi 6 e 7, rispettivamente. Per approfittare del Programma, il Cliente riconosce e conferma di aver effettuato tale ripristino e di aver rimosso tutte le informazioni personali dall'orologio come richiesto. TAG Heuer non potrà essere ritenuta responsabile per la divulgazione o per qualsiasi tipo di elaborazione di informazioni private che non siano state eliminate dall'orologio del Cliente prima del reso o della spedizione.

15.10. È necessario utilizzare i seguenti metodi di pagamento per l'acquisto del nuovo TAG Heuer Connected nell'ambito del Programma: tutte le principali carte di debito o credito, Paypal (solo per acquisti online) o bonifico bancario in alcuni negozi TAG Heuer selezionati in base al Paese. Anche i pagamenti in contanti sono accettati in alcuni negozi TAG Heuer selezionati, nei limiti consentiti dalla legge e dalle nostre politiche interne. Non sono disponibili altri metodi di pagamento (ad es., pagamento a rate attraverso una soluzione di finanziamento, che potrebbe tuttavia essere proposta da TAG Heuer in alcuni paesi per un acquisto standard) per acquisti nell'ambito del Programma.

15.11. Non è possibile combinare più Crediti Trade-In per l'acquisto di un solo TAG Heuer Connected.

15.12. Resi – In generale: Partecipare al Programma non altera il diritto del Cliente di restituire il nuovo TAG Heuer Connected ai sensi delle nostre politiche di reso applicabili, con riferimento ai paragrafi 4, 7 e 8.

15.13. Resi – Acquisti Online: Per i resi del nuovo TAG Heuer Connected acquistato sul nostro sito web, rimborseremo il prezzo dell'acquisto nella stessa valuta e attraverso lo stesso metodo di pagamento utilizzato per acquistare il nuovo TAG Heuer Connected ai sensi dei nostri termini e condizioni di vendita online che possono essere consultati su https://www.tagheuer.com/legal/terms.html; in questo caso la partecipazione al Programma verrà annullata. Qualora il nuovo TAG Heuer Connected venga restituito durante il periodo di reso applicabile e il Cliente ci abbia inviato il proprio orologio per ricevere il Credito Trade-In, effettueremo il reso del vecchio orologio a nostre spese e il Cliente non riceverà alcun Credito Trade-In.

15.14. Resi – Acquisti nei negozi TAG Heuer selezionati: I resi del nuovo TAG Heuer Connected acquistato presso i negozi TAG Heuer selezionati saranno soggetti alla politica di reso applicabile dal negozio in cui il nuovo TAG Heuer Connected è stato acquistato. Chiedere ulteriori informazioni sulla politica di reso agli addetti alle vendite presso il negozio TAG Heuer selezionato.

15.15. TAG Heuer si riserva il diritto di escludere dal Programma specifici modelli o edizioni della nuova collezione TAG Heuer Connected.

15.16. Il Programma è disponibile solo per Clienti che acquisteranno il nuovo TAG Heuer Connected per uso domestico e privato. L'acquisto di un nuovo TAG Heuer Connected a scopo di rivendita è severamente proibito nell'ambito del Programma.

15.17. Il Programma non può essere combinato con altre promozioni, sconti oppure offerte, se non diversamente specificato nei termini e nelle condizioni dell'offerta stessa.

15.18. TAG Heuer si riserva il diritto di interrompere, adattare o modificare il Programma, compresi i valori del Credito Trade-In, i criteri di idoneità, le condizioni trade-in e i Termini del Trade-In in qualsiasi momento.

15.19. L'idoneità al Programma o il Credito Trade-In offerti da TAG Heuer non sono trasferibili a terzi diversi dal Cliente proprietario dell'orologio da rendere o di un nuovo TAG Heuer Connected.

15.20. TAG Heuer si riserva il diritto di declinare o annullare la partecipazione al Programma del Cliente, qualora ritenga a suo insindacabile giudizio che la partecipazione di quest'ultimo abbia uno scopo illegale o fraudolento.

15.21. Ciascuno dei paragrafi dei presenti Termini del Trade-In è singolarmente vincolante. Qualora un tribunale o un'autorità competente decida che uno qualsiasi di questi Termini sia illecito o non applicabile, gli altri paragrafi resteranno validi e applicabili.

15.22. Se non diversamente specificato nei Termini del Trade-In, i nostri termini e condizioni standard per la vendita dei prodotti TAG Heuer (consultabili sul sito www.tagheuer.com/it/it) e che il Cliente dichiara di conoscere, regoleranno l'acquisto da parte del Cliente stesso del nuovo TAG Heuer Connected. In casi di incoerenza o di conflitto tra i Termini del Trade-In e i nostri termini e condizioni standard, i Termini del Trade-In prevarranno.

15.23. I Termini del Trade-In sono regolati dalla legge italiana e i tribunali italiani e avranno potere esclusivo su qualsiasi disputa correlata a questi Termini del Trade-In o comunque riconducibile all’esecuzione del Programma “Trade-in Connected” di cui al punto 1 di queste condizioni specifiche. Qualora sia coinvolto in una controversia un consumatore, la stessa sarà soggetta alla giurisdizione esclusiva del Tribunale del luogo in cui lo stesso ha la propria residenza o domicilio.

16. SPECIFIC ADDITIONAL TERMS & CONDITIONS PER LOCAL JURISDICTION

16.1. FRANCE

YOUR RIGHTS AS A CONSUMER

Notwithstanding anything to the contrary in these Terms, you benefit from the French legal (i) warranty of conformity of the goods described in articles L 217-4 and seq. of the French consumer code and (ii) warranty against hidden defects in the conditions set out in articles 1641 and seq. of the French civil code.

When acting under the legal warranty of conformity, you:

  • are granted a period of two years from the delivery of the good to take action;
  • may choose between the repair or replacement of the good, subject to certain cost conditions set forth in article L 217-9 of the French consumer code;
  • are exempted from providing proof of the existence of the lack of conformity during the first twenty-four months following the delivery of the good.

You may decide to invoke the legal warranty against hidden defects as set forth in article 1641 of the civil code and, in such context, you may choose between the cancellation of the sale or a price reduction, pursuant to article 1644 of the civil code.

In addition to these legal warranties, please note that the Product you purchased may be covered by a commercial warranty under the conditions set out in the warranty document included in the original packaging of the Product.

RETURN - WITHDRAWAL

Under local mandatory law, you benefit from a 14-day withdrawal period. As we want you to be completely happy with your order, subject to certain exceptions detailed below, if for any reason you are not satisfied, we will gladly accept your return within 30 days of receipt of the original item, at our expense.

To return an item, please follow our return process included in your parcel or through this link. You are free to use the standard form accessible at [Hyperlink to insert].

Please note: a return authorization must be requested within 30 days of receiving the Product and the Product returned within 14 days of the return authorization number being issued. In addition, all Products must be returned with the original receipt, in an unused state and in brand-new condition, with all original shipping and Product packaging, protective materials, and tags in place.

We will refund you the price paid for the Product by the method you used for payment, unless you have expressly agreed otherwise. We will proceed to the refund when we receive the Product back, or when you supply evidence of having sent back the goods, whichever is the earliest.

We will not accept any return if the Product shows signs of wear, other than what is necessary to establish the nature, characteristics and functioning of the Product, or has been used or altered from its original condition in any way, or if the deadlines mentioned above have passed.

Clearly personalized Products or Products made according to the consumer's specifications are considered as final sale and cannot be returned for exchange or refund.

OTHER IMPORTANT TERMS

The French consumer may bring a claim before the courts of the place where he/she is domiciled.

16.2. GERMANY

YOUR RIGHTS AS A CONSUMER

Notwithstanding anything to the contrary in these Terms, you benefit from the German legal framework on warranty of conformity of the goods and consumer rights as described in the statutory provisions (esp. sec. 312b et seqq., 433 et seqq. of the German Civil Code).

In the event of a defect of the Product (i.e. if the Product does not meet the specifications agreed between you and us or if the Product is not suitable for use in a manner that you could have expected according to the contract between you and us or as suggested in public statements from us), you are entitled to supplementary performance.

This means in particular, that you:

  • are granted a period of two years from the delivery of the good to take action (sec. 438 sec. 1 No. 3 of the German Civil Code);
  • may initially choose between the repair or replacement of the good, subject to certain conditions set forth in sec. 439 of the German Civil Code;
  • in lieu of having the defect cured, may rescind the contract or have the purchase price reduced. This only applies, however, if you have first set a reasonable deadline to cure the defect and this deadline expires without the defect being cured or if the second attempt to remedy the defect has failed; besides, you are entitled to claim damages in accordance with clause 11;
  • are exempted from providing proof of the existence of a defect of the good during the first six months following the delivery of the good unless proved otherwise (sec. 477 of the German Civil Code).

In addition to these legal warranties, please note that the Product you purchased may be covered by a commercial warranty under the conditions set out in the warranty document included in the original packaging of the Product.

RETURN - WITHDRAWAL

Without limiting your statutory rights to withdraw or rescind the agreement (in particular under applicable long distance selling regulations which grant you a 14-day withdrawal period and of which you will be expressly informed separately in the course of the order process, we want you to be completely happy with your order. Subject to certain exceptions detailed below, if for any reason you are not satisfied, we will gladly accept your return within 30 days of receipt of the original item, at our expense.

OTHER IMPORTANT TERMS FOR GERMAN CONSUMERS

You may choose between the courts territorially competent under the German Civil Procedure Code and the courts of the place where you reside at the time of the conclusion of the Contract or the place where the harmful event occurred.

We inform you according to sec. 36 German VSBG (Gesetz über die alternative Streitbeilegung in Verbrauchersachen) that we are not obliged to take part in an extrajudicial resolution proceeding pursuant to the VSBG.

16.3. ITALY

YOUR RIGHTS AS A CONSUMER

Notwithstanding anything to the contrary in these Terms, you benefit from the Italian legal warranty of conformity of the goods described in articles 128 and seq. of the Legislative Decree no. 206 of September 6, 2005 as amended (“Consumers’ Code”).

We are under a legal duty to supply Products that are in conformity with these Terms. In case the received Products are faulty or misdescribed, you have a legal right to have Products brought into conformity free of charge by repair or replacement at your choice, unless the remedy sought is objectively impossible or excessively expensive compared to the other. Should these remedies be impossible or prohibitively expensive, or should it not be possible to provide them within a reasonable period of time from the request date, you may request, at your choice, to have an appropriate reduction made in the price or the contract cancelled and a total refund of the price paid by you. The same remedies are also applied in the event that the replacement or repair previously carried out caused considerable inconveniences to you.

The warranty period lasts twenty-four (24) months from the date of the delivery of the Product. You shall notify us that the Product is faulty or misdescribed within two (2) months from the detection of the defect, otherwise you will not be entitled to exercise your legal rights. In other words, you are entitled to exercise your legal rights for a period of twenty-six (26) months from the date of the delivery of the Product.

In addition to these legal warranty rights, please note that the Product you purchased may be covered by a commercial warranty under the conditions set out in the warranty document included in the original packaging of the Product.

OTHER IMPORTANT TERMS

The courts of the place where the Italian consumer has his/her residence or domicile have exclusive jurisdiction.

You may also apply for an out-of-court mechanism to solve any lawsuit relating to these Terms with the competent bodies, in accordance with Sections 141 – 141decies of the Italian Consumers’ Code.

16.4. SPAIN

YOUR RIGHTS AS A CONSUMER

Notwithstanding anything to the contrary in these Terms, you benefit from the Spanish legal (i) warranty of conformity of the goods described in articles 118 to 124 of the Spanish Royal Legislative-Decree 1/2007 approving the General Law for the Defence of Consumers and Users; and (ii) warranty against hidden defects in the conditions set out in articles 1474 and 1484 and seq. of the Spanish civil code.

When acting under the legal warranty of conformity, you:

  • are granted a period of two years from the delivery of the good to take action;
  • may choose between the repair or replacement of the good, subject to certain cost conditions set forth in articles 119 to 122 of the General Law for the Defence of Consumers and Users;

You may decide to invoke the legal warranty against hidden defects as set forth in article 1484 of the Spanish civil code and, in such context, you may choose between the cancellation of the sale or a price reduction, pursuant to article 1486 of the Spanish civil code.

In addition to these legal warranty rights, please note that the Product you purchased may be covered by a commercial warranty under the conditions set out in the warranty document included in the original packaging of the Product.
